The research presented a legal and jurisprudential approach regarding the stance on litigation procedures using artificial intelligence, as AI has become an important factor in contemporary justice. The aim of the research is to define the limits within which AI can be used in litigation processes, and the extent to which this is suitable for individual rights and freedoms. It also addresses the effectiveness of using AI to achieve a fair trial and the feasibility of it independently carrying out litigation procedures without human involvement. The research concluded that the default stance on the use of AI is permissibility, governed by the five rules of obligations. While AI contributes to enhancing human welfare, improving the quality of judicial work, reducing the duration of litigation, and achieving prompt justice, its major risks lie in the fear of its independence and loss of control over it by humans. Furthermore, it is unacceptable to concede to AI having jurisdictional authority and issuing judicial rulings; it is merely an assisting tool.
