The administrative judge’s scope of intervention in social security fund disputes in Algeria

The administrative judiciary handles many disputes in accordance with what is stipulated in the legislation, including some social security disputes that are originally subject to private law. Accordingly, we find that the administrative judge has a role in these disputes, considering that social security funds are public facilities with private management and despite the ambiguity in referral to the judiciary, it is not done. This is only after the parties to the dispute submit to an amicable settlement, in which case the administrative judiciary will be competent in the details, considering some actions to be administrative, and this is what has been clarified through this research paper by specifying the resort to the administrative judge as an exception, as his role is limited, and therefore there must be a need to reconsider this and clarify the scope of his jurisdiction in warranty disputes.
