The characterization of shuf'ah significantly impacts its unique provisions and legal implications for parties involved. It substitutes the buyer without consent, forcing the seller to contract with an undesired party. Consequently, the shuf'ah is also coerced into executing an agreement to which they did not consent or contribute. This raises concerns regarding the freedom of contract principle.
