Abstract

The idea of ​​precautionary measures depends on prevention and treatment. In the event that criminal behavior cannot be avoided, he resorts to remedial measures that may appear in the form of penalties that replace the punishment, but despite their efficacy and utilitarian nature, the Algerian legislator did not specify the reasons for the expiration of these precautionary measures.

So the aim of this study was to explain the reasons for the expiration of the precautionary measures of the Algerian legislator, to conclude in the end that the Algerian legislator did not include the reasons for the expiration of the measures in an independent element, but rather mentioned them in scattered texts in the Penal Code and the laws complementing it, while neglecting some reasons such as reconciliation and suspension of implementation , which were adopted by some legislation, such as the Lebanese and Moroccan legislators
