Preventive criminalization as a mechanism to combat the crime of human trafficking in light of Law: 23-04

Preventive criminalization is considered one of the most important aspects of modern criminal policy, and it has been established in various criminal legislations, including Algerian legislation. The legislator has criminalized certain acts as a means of preventing more serious crimes. Among these is the crime of human trafficking, addressed in Law No. 23-04 dated May 7, 2023. In this law, the legislator has affirmed this approach, considering human trafficking as one of the most serious and emerging crimes—particularly because it is a transnational organized crime that affects most countries and societies alike.
Accordingly, this research paper seeks to shed light on the aspects or manifestations of the entrenchment of the concept of preventive criminalization in Law No. 23-04, as a mechanism for preventing the crime of human trafficking, and to assess the adequacy of these legal provisions in their practical implementation.
