Marketing strategy used to create an abnormal sense of urgency in decision-making, thereby affecting the integrity of contractual consent. The study analyzes the legal framework governing such practices in light of both general and special legal rules. It reveals the limitations of the Civil Code in addressing this type of psychological influence, given its incompatibility with modern digital marketing techniques.
Consequently, special laws, notably the Consumer Protection Law and the Commercial Practices Law, were introduced to reinforce the principles of transparency and prior disclosure as essential safeguards against misleading time pressure. Moreover, the research highlights the significance of administrative oversight and the role of mixed sanctions (civil, administrative, and criminal) in ensuring deterrence and prevention. The study concludes with a call to develop legislation and enhance consumer awareness to achieve genuine protection of contractual will in the context of modern promotional offers.
