Abstract

Election is considered the unique mechanism through which power is exercised. Therefore, the legislator has given this process great importance because it is related to the system of government. The electoral process passes through several stages, the most important of which is the voting stage. Therefore, it had to be subject to legal oversight until the principle of legitimacy is embodied, and it is considered to be compatible with the system. Ruling is based on the will and desire of individuals, and legitimacy is among the foundations through which the supremacy of the constitution is achieved. The Algerian legislator has guaranteed the validity of the electoral process by stipulating a set of texts that guarantee the privacy of the voting process. It approved general principles governing it, stipulated the procedures and restrictions to which the electoral process is subject, and guaranteed tools for oversight, including administrative oversight and judicial oversight. It also did not neglect organizing the offices of the voting process, both by stipulating the organization of its members and stipulating the duties of its members.
