Abstract

There are many types of family ownership management in Algerian legislation, and they can be divided into general rules represented in the application of agency rules or ordinary commonality rules, and special rules that the legislator singled out for family ownership due to the specificity of this ownership, since although it is a type of forced commonality, it is subject to special conditions. To establish it, as it arises among members of the same family, and this is what made the legislator single it out with special rules for its management, such as expanding the manager’s authority in the administration unlike the ordinary commons, because the goal of its establishment is to preserve and develop common money and achieve the common interest of the partners .
