The validity of the Medina‘s work people for Specification According to the Malikis, as an independent evidence for them

Abstract

     This research aims to investigate a fundamental issue with a tangible jurisprudential impact. This issue is the specification of the general texte to the work of the people of Medina (eamal 'ahl almadina). The scholars initially disagreed about the validity of the work of the people of Medina and its suitability for building legal rulings, so I wanted to study the issue of specification to the work of the people of Medina. This is something that only those who say that the actions of the people of Medina are authoritative say, but as for those who say that this evidence is not authoritative, then the statement that it is valid to specify the general is more distant.

Accordingly, the issue of specifying the general work of the people of Medina was addressed by the Maliki jurists, as it is consequential evidence according to them, and whoever wants to know the subject and investigate it must refer to the books of the principles of jurisprudence approved in the Maliki school of thought. Because it is a recognized principle in the school of thought, while the rest of the schools of thought did not pay attention to the matter as it is one of the issues of disputed consensus, so this evidence does not exist in their list of consequential evidence, and despite that, there are many branches of jurisprudence in which there is disagreement due; to considering specification of work of the peaple of medina and not considering it.
